La regulación europea de la inteligencia artificial funciona como un calendario. El Reglamento (UE) 2024/1689 despliega sus obligaciones por fechas y por roles, y casi todas las empresas que nos consultan tienen mal resuelta la pregunta previa: si son proveedor o responsable del despliegue de cada sistema que usan. De esa respuesta depende todo lo demás, y se contesta mirando la arquitectura del producto, no la licencia que firmaron.

Por eso tratamos la IA como una cuestión técnica con consecuencias jurídicas. Quien no distingue un modelo de un sistema, o un RAG de un reentrenamiento, no puede clasificar el riesgo ni decir qué obligación aplica. Nosotros lo hacemos por escrito y con fecha.

La segunda convicción es que la mayoría de las empresas necesitan menos de lo que temen y antes de lo que creen. El checklist del AI Act separa lo exigible hoy de lo que llega en diciembre; la autoevaluación lo aplica a tu caso en cinco minutos. Cuando la respuesta es que no te afecta, te lo decimos igual.

Lo que exige criterio es lo que la norma no cubre: la responsabilidad del administrador que despliega IA sin control, la explicación que debes a quien recibe una decisión automatizada, el solapamiento con la regulación sectorial que ya tenías. Ahí un despacho con perfil técnico-jurídico deja de ser un lujo. Esta área es, junto con la de datos, la práctica TechLaw de PASSAS.

European AI regulation works like a calendar. Regulation (EU) 2024/1689 rolls out its obligations by date and by role, and almost every company that consults us has the prior question wrong: whether it is the provider or the deployer of each system it uses. Everything else depends on that answer, and it is answered by looking at the product architecture, not at the licence that was signed.

That is why we treat AI as a technical matter with legal consequences. Anyone who cannot tell a model from a system, or a RAG from a retraining, cannot classify the risk or say which obligation applies. We do it in writing and with a date.

Our second conviction is that most companies need less than they fear and sooner than they think. Our note on the 2 December deadline separates what is enforceable today from what arrives in December; the self-assessment applies it to your case in five minutes. When the answer is that it does not affect you, we say so.

What requires judgement is what the rule does not cover: the personal liability of the director who deploys AI without control, the explanation owed to whoever receives an automated decision, the overlap with the sector regulation you already had.
