Una empresa digital no tiene un problema de protección de datos, tiene un mapa de flujos que nadie ha dibujado. Los datos entran por un formulario, pasan por tres proveedores, cruzan el Atlántico en un servidor de correo y vuelven convertidos en una métrica. Cada tramo de ese recorrido tiene base jurídica o no la tiene, y esa diferencia es exactamente lo que busca un inspector. Nuestro trabajo empieza por dibujar el mapa, porque el cumplimiento que no coincide con el producto es papel.

El derecho europeo de datos ya no es solo el RGPD. El Data Act cambia lo que un proveedor SaaS puede cobrar al cliente que se va, NIS2 alcanza a empresas que no son entidad obligada por la vía de los contratos con sus clientes, y la privacidad de las comunicaciones se decide en Bruselas con plazos que convierten en infracción lo que ayer era práctica habitual. Quien firma sin leer asume obligaciones que la ley no le impone.

Lo tratamos como lo que es: una decisión de negocio con precio cerrado. Si operas desde fuera de la Unión y tratas datos de usuarios europeos, el encargo tiene alcance y precio publicados en EU Data Compliance. Si prefieres empezar midiendo tu propio criterio, El Inspector te sienta cinco minutos en la silla de la AEPD.

A digital company does not have a data protection problem, it has a map of data flows that nobody has drawn. Data comes in through a form, passes through three vendors, crosses the Atlantic inside a mail server and comes back as a metric. Every leg of that journey has a legal basis or it does not, and that difference is exactly what an inspector looks for. Our work starts by drawing the map, because compliance that does not match the product is paperwork.

European data law is no longer just the GDPR. The Data Act reaches SaaS providers with no presence in Europe, NIS2 reaches companies outside its scope through the contracts their customers impose, and the privacy of communications is decided in Brussels on timelines that turn common practice into an infringement overnight. Whoever signs without reading takes on obligations the law never imposed.

We treat it as what it is: a business decision with a fixed price. If you operate from outside the EU and process data of European users, the engagement has a published scope and price: EU Data Compliance. La experiencia en datos de PASSAS viene de haber estado donde se decidía. Estuvimos en Bruselas mientras el RGPD se aprobaba y entraba en vigor, y esa cercanía con la norma se nota en cómo la aplicamos. Dominamos las transferencias transatlánticas, los contratos de encargo, el Data Privacy Framework y la formación de delegados de protección de datos. También sabemos qué ocurre cuando un tratamiento mal resuelto llega a un juzgado, porque parte de nuestros mejores resultados en litigación nacieron de esa perspicacia. Por eso leemos las cláusulas que un cliente grande impone a sus proveedores antes de que alguien las firme, y seguimos lo que se tramita en Bruselas y los litigios que reescriben el paradigma mundial de datos. Somos activistas por la privacidad, y esa convicción es también la ventaja de quien nos contrata.

The data experience of PASSAS comes from having been where the decisions were made. We also know what happens when badly resolved processing reaches a courtroom, because some of our best litigation results were born from that insight. That is why we read the clauses a large customer imposes on its suppliers before anyone signs them, and why we follow what is being negotiated in Brussels and the cases that rewrite the global data paradigm. We are privacy activists, and that conviction is also the advantage of whoever hires us.
