Enforcement of Judgments

You have won the case and now it is time to collect: we will ask the court to enforce the judgment.

We will file the enforcement application and request the appropriate seizures.

Approach

A judgment that is not enforced stays on paper, and the time that passes works in the debtor's favour.

We will ask the court to order enforcement as soon as the judgment allows it.

The debtor's assets

We will request an asset search and the seizure of accounts, salaries or property as appropriate.

If the debtor objects

We will defend your title against the debtor's objection within the same engagement.

Process

How the engagement unfolds

Initial Consultation

A 60-minute working session by video call in which we analyse your situation, your specific needs and our ability to help you. We assess whether we can take on the matter and give you the fixed price in advance. You can book it directly through the Google Calendar link on our website and pay €90 by Stripe.

Strategy Memorandum

Document produced once the engagement is accepted, setting out the agreed legal strategy for the matter. It specifies the procedural approach, the main arguments, the evidence to be deployed and the objectives of the proceedings. It is the roadmap for the case and the reference point for any subsequent tactical decision.

Enforcement Application

The application asking the court to order enforcement of the judgment or other enforceable title, together with the request for an asset search and for the appropriate seizures.

Case Monitoring

Ongoing attention to the matter between the main steps: deadline control, procedural or administrative follow-up, response to requests for correction and management of court notifications. The client hears from us each time there is a development in the file, and never has to ask in order to know what is happening.

What can I enforce?

Judgments, arbitral awards, mediation agreements formalised as enforceable titles and other titles recognised by law. If you are unsure about yours, we will look at it in the Virtual Consultation.

What if the debtor has no assets?

We will ask the court for an asset search. If no assets turn up, we will tell you plainly so that you can decide how to proceed.

From what amount does it fit?

Our fees never exceed 20% of the amount at stake, so it fits when at least €10,000 remains to be collected.

How much does it cost?

From €2,000 + VAT. The fixed price in the engagement letter includes the costs of the proceedings.
