Enforcing Foreign Judgments

A judgment from your country can also be enforced in Spain, and we will take that path with you.

We will seek recognition and enforcement of your judgment in Spain.

Approach

A judgment won abroad only turns into money when a Spanish court orders it to be complied with.

If it comes from the European Union

We will enforce it directly, with the certificate from the court of origin and the necessary translations.

If it comes from elsewhere

We will first seek its recognition through exequatur and then its enforcement: two separate procedures within one engagement.

Down to the debtor's assets

We will request an asset search and the appropriate seizures in Spain.

Process

How the engagement unfolds

Initial Consultation

A 60-minute working session by video call in which we analyse your situation, your specific needs and our ability to help you. We assess whether we can take on the matter and give you the fixed price in advance. You can book it directly through the Google Calendar link on our website and pay €90 by Stripe.

Strategy Memorandum

Document produced once the engagement is accepted, setting out the agreed legal strategy for the matter. It specifies the procedural approach, the main arguments, the evidence to be deployed and the objectives of the proceedings. It is the roadmap for the case and the reference point for any subsequent tactical decision.

Exequatur

The procedure for obtaining recognition in Spain of a judgment given outside the European Union, which is required before it can be enforced.

Enforcement Application

The application asking the court to order enforcement of the judgment or other enforceable title, together with the request for an asset search and for the appropriate seizures.

Case Monitoring

Ongoing attention to the matter between the main steps: deadline control, procedural or administrative follow-up, response to requests for correction and management of court notifications. The client hears from us each time there is a development in the file, and never has to ask in order to know what is happening.

What people ask before instructing this service

Does my judgment need exequatur?

If it comes from another EU Member State, in most cases it does not, because the certificate from the court of origin is enough. If it comes from outside the EU, its recognition through exequatur must be obtained first.

What documents do I need?

The judgment, proof that it is enforceable, the relevant certificate and sworn translations. We will tell you exactly which in the Virtual Consultation.

From what amount does it fit?

Our fees never exceed 20% of the amount at stake, so it fits from €10,000.

How much does it cost?

From €2,000 + VAT. If the judgment needs exequatur, its cost is added in the same engagement letter.
